These Candidate Terms of Service (the "Terms") constitute a legally binding agreement between you and XpressApply Ltd ("XpressApply", "we" or "us"), a private company limited by shares incorporated and registered in the Republic of Cyprus, and govern your access to and use of the XpressApply service as a candidate (the "Service").

By creating an account or otherwise using the Service, you confirm that you accept these Terms. If you do not accept them, you must not use the Service.

1.Definitions and interpretation

  1. 1.1"Interview" means a structured artificial-intelligence interview conducted through the Service; "Scorecard" means the assessment generated from an Interview; and "Customer" means an employer using the Service to assess candidates.
  2. 1.2Headings are for convenience only and do not affect interpretation. Words importing the singular include the plural and vice versa.

2.Eligibility

  1. 2.1You must be at or above the minimum working age applicable in your jurisdiction and have the legal capacity to enter into these Terms.
  2. 2.2You must provide accurate and complete information when registering and keep it up to date.

3.Accounts and security

  1. 3.1You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  2. 3.2You must not share your account, impersonate any person, or create an account on behalf of another person without authority.
  3. 3.3You must notify us promptly of any unauthorised use of your account.

4.The Interview and fair use

  1. 4.1You must complete each Interview personally and must not permit any other person or tool to answer on your behalf.
  2. 4.2You may take one Interview per role family unless we offer you a further opportunity.
  3. 4.3You must not attempt to manipulate, record, reproduce or distribute Interview questions or to otherwise undermine the integrity of the assessment.

5.Your content and consent

  1. 5.1You retain all rights in the content you provide. You grant us a non-exclusive licence to process that content as necessary to provide the Service.
  2. 5.2Where you apply to a Customer, you consent to the disclosure of your profile and Interview evidence to that Customer for so long as your consent remains in place, and you may withdraw that consent at any time.

6.Acceptable use

  1. 6.1You must not use the Service unlawfully, infringe the rights of others, or upload unlawful, harmful or misleading content.
  2. 6.2You must not attempt to gain unauthorised access to, interfere with, scrape or disrupt the Service or its underlying systems.

7.Availability and changes to the Service

  1. 7.1We aim to keep the Service available and accurate but provide it on an "as is" and "as available" basis.
  2. 7.2We may add, modify or discontinue features, and will give reasonable notice of material changes where practicable.

8.Intellectual property

  1. 8.1The Service, including its software, design and content (excluding your content), is owned by us or our licensors and is protected by intellectual-property laws. No rights are granted to you except as expressly set out in these Terms.

9.Disclaimers

  1. 9.1To the fullest extent permitted by law, we exclude all implied warranties in relation to the Service. A Scorecard is decision support and does not guarantee any particular hiring outcome.

10.Limitation of liability

  1. 10.1Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including your rights as a consumer.
  2. 10.2Subject to the foregoing, we are not liable for indirect or consequential loss, or for loss of profits, opportunity or data, arising out of or in connection with the Service.

11.Term and termination

  1. 11.1These Terms apply for as long as you use the Service. You may close your account and request deletion of your data at any time.
  2. 11.2We may suspend or terminate your access where you materially breach these Terms or where required by law.

12.Governing law and jurisdiction

  1. 12.1These Terms are governed by the laws of the Republic of Cyprus.
  2. 12.2The courts of the Republic of Cyprus have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.

13.Changes to these Terms and contact

  1. 13.1We may amend these Terms from time to time and will notify you of material changes before they take effect.
